Lambourn Parish Council Freedom of Information Act 2000 Procedure and Publication Scheme

Lambourn Parish Council’s (“LPC”) is obliged to comply with legislation. The Freedom of Information Act 2000 gives individuals the right to obtain information held by public authorities unless there are good reasons for keeping it confidential.

The Information Commissioner’s Office (“ICO”) is the UK’s independent public body set up to promote access to official information and protect personal information. It has responsibility for ensuring that information is disclosed promptly and that exemptions from disclosure are applied lawfully. Some information could be exempt from disclosure.

1. How to make a request

When making a request, make the information as specific as possible, to avoid delays. Provide as full a description as possible of the information required, clearly defining your preferred format for receipt of the information.

All requests received will be responded to promptly, with a confirmation of receipt. Communication is key to ensure that all parties involved are aware of any delays where necessary.

If LPC declare the information exempt, a full explanation must be given.

The individual must be made aware of their right to complain to the ICO.

Where upon the ICO may decide that the request has been handled correctly or instruct LPC to disclose the information. Non-compliance with a decision may constitute contempt of court.

If the individual disagrees with the ICO decision, an appeal must be made within 28 days to the Independent Information Tribunal.

The Information Tribunal may uphold the ICO’s decision notice, amend it or overturn it. Noncompliance with the Information Tribunal’s notice may also constitute contempt of court.

Under the Freedom of Information Act it is the duty of every public authority to adopt and maintain a publication scheme.
